Why You Need A Power Of Attorney:
Having a Power of Attorney is an important part of planning for the unknown. If you are injured in a way that incapacitates you and you are unable to communicate or make your wishes known, someone will have to that on your behalf.
There are only two ways that anyone can do that for you:
Power of Attorney –
The first way is for you to designate a spouse or other trusted person as your Power of Attorney. This can be done in a matter of minutes, costs far less than the alternative and does not involve going to court or reporting back to a court.
Court Ordered Guardianship/Conservatorship –
The second way is Guardianship. This can only be accomplished by filing a petition and having a hearing before a Judge after going through several other legal processes. It will take weeks or longer and cost thousands of dollars.
Additionally, if your needs involve the person having control over or access to your finances, then an additional Court order for Conservatorship will be needed, a civil bond will have to be posted and regular reporting to the Court will be required. This is an involved and expensive process and can be very stressful to go through on top of whatever has occurred to cause you to need to do it.
Get It BEFORE you Need It –
A Power of Attorney is something that you need to put in place BEFORE you actually need it. If you are suddenly thrust into a set of circumstances where you require a Power of Attorney, it will be too late for you to obtain one. At that point you will have no option available other than the Guardianship/Conservatorship.
